Secahosting Terms Of Service |
Where the content states: "We" includes Secahosting
or any party acting on Secahosting's implicit instructions.
"You" includes the person purchasing the services
or any party acting on the customer's instructions.
"Member" includes the purchaser of services
or any party acting on the purchaser's instructions.
"The Registrant" includes the person applying
for a domain name or any party acting on the Registrant's
instructions. "The Registry" refers to the
relevant domain names Registry. "Server" means
the computer server equipment in connection with the
provision of the Services. "Web Site" means
the area on the Server allocated by us to you for use
by you as a site on the Internet. "TOS" includes
this agreement. Secahosting reserves the right to modify
this policy at any time, effective immediately upon
posting of the modification to this URL: http://www.secahosting.net/tos.php.
In consideration of the mutual covenants herein, the
parties agree to the following, which shall apply during
the term of this agreement:
1. New Accounts
All new web hosting accounts purchased on our
order page are set up within 24 hours by our account
administrators. You will receive two (2) emails including
login details after your purchase. Due to unforeseen
complications with various mail servers and any connection
problems between your ISP and Secahosting, this process
may sometimes be delayed.
2. Domain Names and Domain
Transfers
In order for your domain name to point to the Secahosting
server your new account is located on, you must change
your DNS (Domain Name Servers) at your registrar.
These DNS are located in your welcome email and they
are defined in a pair (primary- ns*.secahosting.com
and secondary- ns*.secahosting.com). Please note: Our
DNS are unique to each server so if you sign up and
then a few months later open another account, you will
not be using the same DNS as before.
Please be aware that the above process is not known
as a domain transfer. A domain transfer is if you want
to physically transfer your domain to Secahosting Domains
and away from your original registrar. You must create
an account at Secahosting domains and initiate a transfer.
A domain transfer is $15.99 and that goes toward one
year of registration with Secahosting domains, added
on to your current registration period with the previous
registrar.
Secahosting will take necessary steps to register domain
names on behalf of the client when requested. However,
clients are responsible for renewing their domain names.
Secahosting Domains does not take responsibility for
failing to renew domain names. If your domain name was
registered via our company, you must check and take
appropriate actions to renew a domain that is about
to expire.
We do not handle renewals unless specifically asked
for by sending a ticket to our helpdesk. If you have

3. Content
Secahosting, believes in freedom of speech; however,
any content (written, visual, or implied) in the following
areas will not be tolerated and is grounds for immediate
suspension of service (in most cases customer will be
allowed a zip file of their account): racism or prejudice
due to colour, creed, or belief; any violent/malicious/obscene
content written, visual or implied.
We will not tolerate any type of hate site including
terrorist related websites on our network.
If we receive notice that there is such a hate site
hosted within our network, the customer hosting the
material will be notified immediately. They are required
to remove the content within a certain timeframe or
will face account suspension and/or termination.
We prefer that you self-govern your content and remain
responsible and all-knowing of what your website publically
provides.
Even if other users have access to your account, you
are responsible for their actions.
The resources and time needed to govern our servers
by checking each website individualy, which have growing
and evolving content, is impossible.
However, if Secahosting, is made aware of any questionable
content on a Secahosting-hosted site, we will address
the concerns immediately and directly with you to seek
an amiable resolution.
If any person contacts us about content they have
found on a Secahosting server that copyrights their
own material or that they wish to be removed, we require
a proper DMCA notice to begin investigation.

4. Satisfaction Guaranteed
30 Day Guarantee Statement
Shared and Reseller Accounts If for any reason
you are unhappy with the services you receive from Secahosting
during the first 30 days of service, you may request
in writing via email or by our cancellation form (as
mentioned below) that your services be discontinued
at which time you will receive a full refund.
You must also state a detailed reason as to why
you are cancelling (as we request for any cancellation,
no matter the time frame). We are the sole arbiter as
to if your reason is a valid reason and if all possible
steps were taken on your side and on ours to correct
the situation causing the interest to cancel.

5. Payment
All payments will be charged to your PayPal account.
Accounts 15 days past due will require a $15.00 USD
fee to enable.
We only accept PayPal for payment of services.
Yearly plans renew automatically and are charged to
the most recently updated PayPal address on file.
In the event that your yearly charge is denied
and we are unable to contact you, then the aforementioned
fees to enable your account shall apply.
Monthly payments will incur unless you submit proper
cancellation of account. Any debt not paid will be forwarded
to a collections agency.

6. Cancellations
Shared/Reseller/Dedicated/VPS Accounts - If you wish
to cancel your services, you must complete this cancellation
form five (5) business days prior to your renewal date.
If your notice of cancellation is not received within
this time frame, you are liable for payment of the proceeding
and hereby agree to be complete payment as invoiced
accordingly. The cancellation form is located here:

If you cancel your account and your payments still
continue to recur for any reason such as
1) by fault of Secahosting staff
2) by fault of the credit card processor
3) by fault of any other payment collection company
we are to be held free of liability for any overdraft
fees that are issued by your financial institution.
7. Refunds/Account Termination
If, for any reason, Secahosting fails to deliver
said services to you, a prorated refund will be issued.
No refunds will be issued if abuse of our stated policies
forces Secahosting to suspend or terminate your services
prematurely.
In the event you request account cancellation, once
your service has been cancelled your account will be
suspended from use. It will then be deleted within 30
days.
If for any other reason your account becomes suspended
and remains suspended it will be deleted after a 30-day
period.
8. Overage Charges
Our service plans are designed to accommodate
the majority of usage scenarios given the needs of our
customers. However, your usage may vary and require
additional allocations, specifically in the areas of
storage and traffic. We will never charge your card
automatically if your account requires more resources.
You must keep your email address updated within your
cPanel, so that you may receive an email when your account
reaches certain limits determined solely by our system,
ie. bandwidth exceedment warning at 80% at which time
you may contact us to purchase a higher transfer quota
for your account. If you do not contact us, the system
will suspend your site if your allotments exceed.

9. Liabilities
Secahosting, makes no endorsement, claims, or promises
regarding the services offered by our customers and
will not be held liable for any disputes or claims against
said customers.
In no event shall Secahosting. be liable for any direct,
indirect, incidental, consequential, special and exemplary
damages, or any damages whatsoever, arising from the
use or performance of a customer web site or from any
information, services or products provided through a
customer web site.
If there is questionable content on any server in our
network, we will not take any action against any material
or action until the website is brought to our attention
by contacting our abuse department. You may visit our

10. Notices
Any notice to be given by either party to the other
may be sent by either email, fax or recorded delivery
to the address of the other party as appearing in this
Agreement or ancillary application forms or such other
address as such party may from time to time have communicated
to the other in writing, and if sent by email shall
unless the contrary is proved be deemed to be received
on the day it was sent or if sent by fax shall be deemed
to be served on receipt of an error free transmission
report, or if sent by recorded delivery shall be deemed
to be served two days following the date of posting.
11. Support
On our site you will find
links to all the information to get your web site up
and running. All information pertaining to your account
should have been included in the Welcome Letter you
received when we created your account. If you did not
receive a welcome letter email, please contact Helpdesk.
There are several reasons an email may not reach you;
first and foremost is if the domain you have contracted
services for is the same domain your welcome email was
sent to.
The support feature of our
service at present time consists of our Support
System solving server related problems only.
If you require support for your scripting,
there are several online tutorials available we can
help you find. You may purchase our technicians' services
at the rate of $80 per hour, with one half hour minimum
billed. We reserve the right to wave this fee at any
time.
Support can only be addressed
in English through our Support
System.
All Support requests are to
be processed through our Support
System. Any other request for support, except as
noted below, will be considered a breach of our TOS.
In the event of a server outage
or other such emergency, you are free to contact us
in any manner.

12. Headings
Headings are included in this Agreement for convenience
only and shall not affect the construction or interpretation
of this Agreement.
13. Torturous Conduct
No one shall post defamatory, scandalous, or private
information about a person without their consent, intentionally
inflicting emotional distress, or violating trademarks,
copyrights, or other intellectual property rights.
Any abuse towards any Secahosting employee will not
be tolerated. You are expected to request and respond
to support and other issues in a professional manner.
When emailing Secahosting or utilizing the Ticket
Desk Support System, refrain from using caps, exclamation
points, and other forms of written yelling. Any cursing,
yelling, or further intentional disruptive behavior
aimed at Secahosting or it's employees shall be considered
a violation of this TOS.
Any threat; whether verbally, orally, written, or delivered
by second parties directed towards Secahosting or any
of it's employees, partners, equipment, and concerns
shall be construed as a violation of this TOS.
Any conduct viewed as violating this section shall be
considered a violation of this TOS. Secahosting will
be the sole arbitrator in regards to what is deemed
a violation.
No refunds shall be given when the contents of this
section necessitates removal of the account.

14. Entire Agreement
These terms and conditions together with any documents
expressly referred to in them, contain the entire Agreement
between us relating to the subject matter covered and
supersede any previous Agreements, arrangements, undertakings
or proposals, written or oral: between us in relation
to such matters. No oral explanation or oral information
given by any party shall alter the interpretation of
these terms and conditions. In agreeing to these terms
and conditions, you have not relied on any representation
other than those expressly stated in these terms and
conditions and you agree that you shall have no remedy
in respect of any misrepresentation which has not been
made expressly in this Agreement.
Secahosting reserves the right to amend these TOS at any
time.
It is your responsibility to check these Terms of Service
on occasion for any such amendments. 15.
Freedom to use these Terms
You (anyone viewing this page) are free to use these terms
as a template for writing your own. Please have it reviewed
by a local attorney/solicitor to make certain it conforms
with your applicable laws. You will also wish to confirm
that the terms you create using this form as a template
conform to your upstream provider.
Secahosting releases rights to this document text to the
reader, free of encumbrance. Except as noted in this section.
In no form can you hold Secahosting responsible for any
and all actions arising out of your use of these terms
as your own.
If you choose to use these terms as your own, this section
(15) must remain intact of content; save for our name.
You agree to let others use these terms as a guide.
Our release of this text material in no way assigns rights
of any images viewed herein. |
